COMMENT 1 - CONTRADICTORY INFORMATION.
The Brierley Hill Inset Map shows Daniels Wharf ( or Land) as including the following BHAAP Development Blocks (North to South) - BR16D, BR 15G and BR 150.
However, in Draft Dudley Local Plan - Part 1 , Appendix 2 Page 436 it says "BR15D has been removed as an allocation" and "BR15G and BR16D has been carried forward as part of a housing allocation OLP BH H002" Clearly, "DLP BH H002" should be OLP BH PS2 - but, other than that, either BR 150 has been removed or it has not -- the Appendix 2 and the Map contradict each other. So this needs sorting out.

COMMENT 2- OBJECTION Paragraph 5.j. DESIGN PRINCIPLES
Quote: "New development at this location will represent higher density development (likely to be a
minimum of 100dph but parts of the site may be appropriate for even higher density development)."
• 300 Dwellings are proposed for this site and the latest SHLAA puts density at 140DPH
• Table 8.2 Dudley Borough Housing Accessibility Standards in Part 1 of this Draft OLP, classifies
1 00DPH as very high-density 100% Flats and of low suitability for Families.
So, that density would result in 300 Flats concentrated in quite a substantial area and occupied by few if any families -- which is hardly a desirable balance.
An aim of Policy DLP1 Development Strategy is to create "sustainable mixed communities".
I believe that a high proportion of Families is essential to achieve that aim and the proposed density would fail to do that.
Also at that density, I would expect the necessary buildings to be much higher than the three storeys typical of Brierley Hill Town Centre. That would lead to disruption of the view mentioned in Policy DLPBH2.
So, although I support the provision in principle of Housing on that site, I object to anything near that density of Housing.

I refer to that untouched by human hand or foot for decades, Daniels Land at Merry Hill SC. Certainly, an important nature reserve that is deserving of an ecological survey to determine its value - so says English Nature in their email, anting me to do it! Possible Great Crested newts, as are found a mile up the road at Fens Pool Nature Reserve and SSSI.

Part 2 DLPBHPS2:
Support the allocation of The Embankment / Daniels Land but as per previous representations in
connection with the draft AAP (now abandoned), request greater flexibility as to types of uses that
would be permissible to come forward in this location. Indeed, whilst the encouragement of an
expanded residential community within and around the Strategic Centre is supported to facilitate
balanced and mixed communities, this should not be at the expense of other uses that have the
potential to support and enhance the commercial function of the Strategic Centre (including
meanwhile / temporary uses). This site has failed to come forward for redevelopment despite having
been identified in the current Area Action Plan for Brierley Hill. In brief therefore, an alternative land
use strategy may be necessary as it is not guaranteed that this site will represent a viable
proposition for the delivery of residential uses across the lifetime of the emerging Plan.

Recommend additional wording to policy as follows: "In the event that proposals for residential development are not deliverable then an alternative use that supports and enhances the commercial
function of the Strategic Centre and supports the overarching objectives of the Plan will be encouraged. This alternative use will need to have regard to and adhere to the remaining policies of
this Plan".

Representation Summary:

Note that Part 5 of the policy allocation identifies the impact on infrastructure provision, and whilst open space requirements are included there is currently no provision within the policy for sport and physical activity infrastructure. Raise an objection to the allocation which could be addressed by including an appropriate reference to meeting the needs of the development for playing pitches and built sports facilities in line with the policies and evidence base referenced.
